(TeaParty.org Exclusive) – Two women have been fighting their town to preserve their First Amendment rights and it looks like their fight has paid off.
Roselle Park, New Jersey has voluntarily dropped its efforts to get the two women to remove yard signs from their yards under the guise of the signs violating a local ordinance that prohibits “obscene material” from being publicly displayed.
While the signs do contain expletives, we all know the real reason for the issue with the signs is that they are anti-Joe Biden. If the vulgar signs were anti-Trump, nobody from the town would even so much as bat an eye.
According to WND, the New Jersey chapter of the American Civil Liberties Union (ACLU) announced they planned to represent the two women and Roselle Park responded by withdrawing their efforts against them.
The homeowner, Patricia Dilascio, had been ordered by Roselle Park Municipal Court Judge Gary Bundy to remove the anti-Biden signs she had put in her yard with her daughter Andrea Dick.
The judge asserted that the signs violated a borough ordinance prohibiting obscenities, as reported by NJ Advance Media.
The local ordinance prohibits “any obscene material, communication or performance or other article or item which is obscene within the borough.” The pair were represented by ACLU attorney Alexander Shalom, who appealed to the Superior Court in Union County, according to NJ Advance Media’s report.
The signs are quite graphic, including phrases like “F*** Biden” and “F*** you for voting for him,” and “F*** Biden, not my president.” The two women faced fines of $250 per day for not taking them down.
After Roselle Park decided to drop their efforts against the women, Dick told NJ.com that it was a “relief” and that she and her mother “both feel so relieved. I’m just happy this [is] all over.”
Executive Director Amol Sinha of the ACLU of NJ, said in a statement following the reversal, “The First Amendment exists specifically to make sure people can express strong opinions on political issues – or any other matter – without fear of punishment by the government.”
“Today’s decision confirms that our position was correct: Roselle Park had no grounds to issue fines for a political sign and the town’s use of its obscenity ordinance infringed upon fundamental rights protected by the First Amendment,” she wrote.
Roselle Park Mayor Joseph Signorello contends that the primary concern with the signs was the fact that they are located in close proximity to an elementary school.
“At the end of the day you can’t legislate decency,” Signorello told NJ.com. “Cost is definitely a factor here and that can’t be denied.”
Perhaps the women don’t need to use expletives to express their disdain for the Biden regime however in America all speech should be protected. What is not protected is how people feel in response to free speech.
We’ve seen in recent years liberals fighting for their feelings to trump free speech but at the end of the day every American has the ability and the option to simply walk away from and ignore things said that they don’t agree with.
